TERMS OF USE AND SERVICE
TRIXTER INTERACTIVE

1. Introduction

​

These Terms of Use and Service (“Terms”) govern access to and use of the games and other digital products of Trixter Serviços de Tecnologia e Consultoria Ltda. (“Trixter Interactive,” “Trixter,” “we”), a Brazilian game developer behind the Zumbi Olé franchise and additional titles. By accessing, installing, or using any of our games (“Games”) on any platform—including mobile devices (Android and iOS), PC (Steam, Epic Games Store), and consoles (Nintendo Switch, PlayStation 5, Xbox Series X|S)—you (“User” or “Player”) acknowledge that you have read, understood, and agree to be bound by these Terms in full.

Our Games may be distributed via third parties such as Steam, App Store, Google Play, Epic Games Store, and console platforms. In addition to these Terms, the applicable terms and policies of those third parties may also apply. Acceptance of these Terms is a condition precedent to using the Games; we therefore make this document easily accessible and request clear consent before any interaction with distribution platforms.

2. Definitions

​

Games: Any software, digital product, or application for mobile, console, or PC developed or distributed by Trixter, including Zumbi Olé Remaster, Zumbi Olé Arena, and future releases.

User / Player: Any natural person who accesses or uses the Games.

​

Platforms: Digital distribution stores and services such as Steam, App Store, Google Play, Epic Games Store, Nintendo eShop, PlayStation Store, and Microsoft Store, as well as our official web pages.

​

Account: An individual registration (owned by the User or provided by third parties) enabling access to specific Game features such as progression, leaderboards, or purchases.

​

3. Acceptance Mechanism & Adhesion Contract

​

The Games are offered under an adhesion (standard-form) contract, meaning the same rules apply to all Users without individual negotiation. To ensure enforceability, we follow best practices: these Terms are presented clearly, in accessible language, and are provided prior to any interaction with the Games. Where available, we use clickwrap agreements requiring the User to tick a checkbox or press a button to indicate consent. In other cases, continued use of the Games constitutes acceptance under browsewrap principles.

If you do not agree to these Terms, do not download, install, or use the Games. We may request renewed consent at any time, especially when these Terms are updated.

4. License Grant

Trixter grants the User a limited, personal, revocable, non-transferable, non-exclusive license to download, install, and use the Games solely for personal entertainment. This license does not transfer ownership of the software or any intellectual property rights. The following are prohibited:

​

  • Copying, modifying, translating, decompiling, reverse engineering, disassembling, or otherwise attempting to derive the Games’ source code;

​

  • Selling, reselling, renting, sublicensing, lending, distributing, or commercially exploiting the Games or any component thereof;

​

  • Creating derivative works based on the Games;

​

  • Using the Games for commercial exhibitions, public performances, wagering, or gambling;

​

  • Transferring the Account or virtual items to third parties in any manner.

​

All copyrights, trademarks, characters, soundtracks, storylines, names, and other Game elements are owned by Trixter or its licensors and are protected by Brazilian intellectual property laws. Brazil’s Legal Framework for Games (Law No. 14,852/2024) recognizes game developers as creators of interactive audiovisual works and safeguards related copyright and industrial property rights.

5. Registration, Accounts, and Security

​

Some Games may require creation of a Trixter Account or use of third-party credentials (e.g., Apple ID, Google Play Games, Steam). The User must provide accurate, complete, and up-to-date information and is responsible for maintaining the confidentiality of credentials. Account sharing is prohibited. The User is liable for all activity conducted through their Account, including by third parties.

Trixter may, at its discretion, suspend or terminate Accounts that violate these Terms or remain inactive for an extended period. If unauthorized access is suspected, the User must notify us immediately.

6. Age Rating and Minimum Age

Each Game’s age rating is displayed on the relevant store pages and our official channels. In accordance with Brazilian law—particularly the Child and Adolescent Statute and the Legal Framework for Games—protections for children and adolescents are implemented. Users under 18 must obtain consent from a legal guardian before playing or making purchases. In-game purchasing tools are restricted for children and require parental consent.

By accepting these Terms, the User represents that they meet the minimum age requirement for the specific Game or are duly authorized by a legal guardian. If we have reason to believe the User does not meet age requirements or lacks authorization, we may suspend or terminate access.

7. Purchases, Microtransactions, and Virtual Currency

​

Some Games offer virtual items, subscriptions, expansions, season passes, or other paid features (“Paid Content”). Purchases are processed by third-party Platforms (e.g., Steam, App Store, Google Play, Epic Games Store, Nintendo, PlayStation, Microsoft) and are subject to their payment terms, refund policies, and taxes. Pricing may vary by geography and applicable fees.

Virtual items and currency: Unless otherwise mandated by law, virtual items, currency, or credits have no real-world monetary value, are not owned by the User, and may not be exchanged for cash, goods, or services outside the Game. Trixter may modify, rebalance, or remove virtual items at any time, including as part of balance updates or experience adjustments. Purchases of virtual items are final and non-refundable, except as required by law or in accordance with the Platform’s policy.

Subscriptions and recurring services: Where applicable, subscriptions automatically renew until canceled by the User. Subscription management and cancellation occur through the originating Platform.

8. Code of Conduct & Acceptable Use

​

To ensure a healthy, competitive, and inclusive play environment, the following are prohibited:

​

  • Harassment, discrimination, or hate speech: Offending, intimidating, defaming, discriminating, or engaging in any form of verbal or symbolic violence against others based on race, ethnicity, origin, gender, sexual orientation, religion, disability, or any similar status.

​

  • Hacks, bots, and cheating: Using programs, scripts, macros, automation, cheats, mods, or exploit tools that alter gameplay or provide unfair advantages. Such practices interfere with software operation and are typically forbidden under game terms.

​

  • Bug exploitation: Leveraging glitches or errors to gain undue benefits or harm other players.

​

  • Illegal content distribution or promotion: Including child sexual abuse material, violent or extremist content, defamatory content, or IP-infringing materials.

​

  • Trading or transferring Accounts/items: Selling, trading, or brokering Accounts, virtual currency, or in-game items for money, credits, or off-platform items.

​

  • Fraudulent behavior: Deception, payment system abuse, or improper chargebacks.

​

Trixter reserves the right to monitor in-Game activity, accept reports, and apply disciplinary measures such as warnings, temporary suspensions, item removal, permanent bans, or other appropriate sanctions. Penalties are designed to preserve Game balance and integrity and may result in loss of purchased items without refund, consistent with prevailing jurisprudence.

9. User-Generated Content (UGC)

​

Some Games enable Users to create, submit, or share text, character names, images, clips, screenshots, or other content (“UGC”). By generating UGC, the User represents they hold all necessary rights and grants Trixter a worldwide, irrevocable, royalty-free, sublicensable, non-exclusive license to use, reproduce, modify, adapt, publish, translate, distribute, display, and transmit such content in any media for Game-related purposes and to promote the Trixter brand.

UGC that violates these Terms, applicable law, or third-party rights is prohibited. Trixter may remove or block UGC deemed inappropriate or unlawful.

10. Updates, Changes, and Online Services

​

Trixter may periodically provide updates, hotfixes, patches, expansions, upgrades, or other modifications to the Games. These may be required to improve gameplay, fix bugs, rebalance, introduce features, or comply with legal requirements. The User agrees Trixter may implement such updates automatically or require the User to download and install them to continue using the Game.

​

Certain features—such as online modes, leaderboards, events, or servers—may be available for a limited time. Trixter reserves the right to modify or discontinue any online service, feature, or game mode at its discretion.

11. Intellectual Property & Trademarks

​

Trixter and its partners own all intellectual property rights in the Games and all related elements—including software, code, characters, environments, names, logos, music, stories, artwork, and other content—protected by applicable law. The User acquires no ownership rights beyond the limited license granted herein.

​

Unauthorized use of Trixter trademarks and logos, domain registrations incorporating our marks, derivative products, unauthorized copies, or any commercial use of Game elements is strictly prohibited.

12. Disclaimers and Limitation of Liability

​

The Games are provided “as is” without warranties of any kind, express or implied. Trixter does not warrant that the Games will:

​

  • Operate uninterrupted or error-free;

  • Be compatible with all devices, operating systems, or hardware;

  • Meet the User’s specific expectations or requirements;

  • Remain continuously available; availability may depend on third-party services and factors beyond our control.

​

To the maximum extent permitted by Brazilian law, Trixter shall not be liable for indirect, incidental, special, consequential, or punitive damages, nor for lost profits, data loss, or other intangible losses arising from use of or inability to use the Games. In no event shall Trixter’s aggregate liability exceed the amount actually paid by the User for access to the Game that gave rise to the claim.

Some jurisdictions do not allow certain warranty exclusions or liability limitations. In such cases, the limitations herein apply to the fullest extent permitted by applicable law.

13. Indemnification

​

The User agrees to indemnify, defend, and hold harmless Trixter, its directors, partners, employees, and affiliates from and against any liabilities, damages, losses, claims, or expenses (including reasonable attorneys’ fees) arising out of: (i) breach of these Terms or applicable law; (ii) misuse of the Games; (iii) violation of third-party rights; or (iv) User-Generated Content.

14. Privacy Policy

Protecting personal data is a priority. Our practices align with Brazil’s Lei Geral de Proteção de Dados (LGPD) and other applicable regulations. Information collected is used to operate, maintain, and improve the Games, provide support, personalize experiences, and comply with legal obligations. Processing of personal data is described in our separate Privacy Policy. By using the Games, the User consents to data processing in accordance with that policy.

15. Third-Party Services and Content

​

The Games may include links to or integrations with third-party services, advertisements, or content (e.g., payment processors, social networks, streaming platforms). Trixter does not control and is not responsible for third-party content, policies, or practices. Interactions with third-party services are governed by their respective terms and policies. We recommend reviewing those terms and privacy policies before use.

16. Suspension and Termination

​

Trixter may, at any time and for legitimate reasons, suspend or terminate a User’s access to the Games—including issuing permanent bans—if it determines there has been a violation of these Terms, unlawful conduct, abusive use, or a threat to service integrity or the community. Such actions may result in loss of Game progress, virtual items, or other benefits without refund, consistent with court decisions recognizing developers’ prerogatives to sanction and deny refunds in ban cases.

Similarly, we may discontinue all or part of a Game’s online services for commercial, operational, or legal reasons. Where feasible, we will provide reasonable advance notice of service deprecation.

​

17. Changes to These Terms

​

We reserve the right to modify these Terms at any time. Updates will be published on our official website and, where relevant, notified via the Platforms or the email address associated with the User’s Account. Continued use of the Games after publication of a new version constitutes acceptance of the changes. Users are encouraged to review these Terms periodically.

18. Governing Law and Venue

​

These Terms are governed by the laws of the Federative Republic of Brazil. Any dispute related to these Terms or the use of the Games shall be submitted to the courts of Osasco, State of São Paulo, to the exclusion of any other venue, however privileged it may be. If the User resides outside Brazil, additional consumer protection rights under local law may apply; however, where legally permissible, Brazilian venue shall prevail.

19. General Provisions

​

If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in full force and effect. Trixter may assign or transfer its rights and obligations to third parties provided the User’s rights are not adversely affected. The User may not assign their rights without Trixter’s prior consent.

​

These Terms constitute the entire agreement between the User and Trixter regarding the Games and supersede all prior communications, proposals, or agreements, whether written or oral. Any tolerance or failure by Trixter to enforce any provision does not constitute a waiver and does not affect Trixter’s right to enforce such provision subsequently.
